9. Promotion and Privacy Rules

The primary purpose of the Building Bonds Scholarship program is to address the impending elder care crisis by supporting initiatives and education that contribute to solving this critical issue. While submissions may be used for promotional, educational, or marketing purposes related to the Scholarship, the program is not intended to serve as a sales generator or a content production tool.

Sponsors are encouraged to promote the program, including submissions and winners, on social media platforms. However, submissions may not be used as a lead generation tool to market directly to applicants. Sponsors must refrain from spamming or unsolicited contact with applicants.

10. Privacy Policy

Personal information collected through the application process will be used solely for administering the Scholarship and related communications. Information will not be shared with third parties without the applicant’s consent, except as required by law. This Privacy Policy applies specifically to the Scholarship section of the Site. These Terms and Conditions may be updated at any time, and participants are responsible for reviewing any updates.

13. Limitation of Liability

The Scholarship program is not responsible for lost, late, misdirected, or incomplete applications, technical issues affecting submissions, or any damages, losses, or expenses arising from participation. If any local law invalidates participation, the transaction may be voided and recipients may be required to return the scholarship funds. In no event shall the program’s liability exceed the amount of the scholarship award.

14. Governing Law and Arbitration

These Terms and Conditions are governed by the laws of the State of Ohio. Any disputes arising from the Scholarship will be resolved in Ohio courts or through binding arbitration under the rules of the American Arbitration Association. Arbitration shall take place in Ohio, and the arbitrator’s decision is final and binding. Applicants agree to indemnify and hold harmless Nagashima Pavarini Ltd., its sponsors, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from participation. The arbitrator may allocate costs, fees, and expenses, including attorneys' fees. Unless otherwise agreed, each party will initially share arbitration costs equally; in jurisdictions where prevailing party clauses are prohibited, each party shall bear its own costs.
